PRICES: Prices in this list are based upon present market conditions and are subject to change without notice. All prices are wholesale prices and are F.O.B. NURSERY, McMINNVILLE, TENNESSEE. TERMS AND CONDITIONS OF SALE: Orders will need to be called in to (931) 668-4431 or Fax to (931) 668-3238. Our office hours are Monday thru Friday 8:00 AM until 4:00 PM. Free quotes given for needed plant material. Minimum order of $200.00. Catalogs mailed upon request. TERMS: One-half down with acceptance of order, balance due before or at the time of shipping. CANCELLATIONS: Any cancellation must be in writing, and received by us prior to January 15th. CONDITIONS OF SALE: All orders are accepted subject to crop failures or damage by natural causes, and we reserve the right to refund all or any part of payment made. We are careful to keep varieties true to name and will replace upon proper proof anything that may be otherwise or refund original purchase price but not more than this amount. We give no warranty expressed or implied as to the growth or productivity. All orders are accepted without liability for non-performance if labor shortages or delay in transportation should prevent us from making delivery. LIVABILITY OF PLANTS THAT WE SHIP. Claims for shortages should be made in writing within 10 days. We cannot assume responsibility for stock damaged after acceptance by common carrier. WHEN ANY DAMAGE IS APPARENT or for any reason you believe you have a complaint, MAKE IT TO YOUR DELIVERING CARRIER WHEN STOCK IS DELIVERED. This is important. PACKING No charge is made when stock is loaded in bulk in car or truck. We do charge for boxing and packing at cost of material used, when plants are shipped other than truck. TRANSPORTATION Please give definite shipping instructions. We offer the following: Parcel Post, Motor Freight, United Parcel and Trailers. ALL SHIPMENTS TRAVEL AT THE RISK AND EXPENSE OF PURCHASER. LATE PAYMENT: A charge of I 1/2% per month (a true annual rate of 18%) will be made after 30 days on unpaid balances. The parties hereto agree that any dispute arising out of the sale of these goods shall be arbitrated exclusively in the Chancery Court for Warren County, Tennessee and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Purchaser agrees to pay a reasonable collection and/or attorney fee in the event of nonpayment. TRUCKLOAD DELIVERY Write or phone us and we will make arrangements. We have access to local trailers for delivery. All rates are figured at present trucking cost and are subject to change due to conditions beyond our control. Smaller shipments can often be pooled or combined to nurseries within a reasonable area. This cost to be prorated according to space and weight of your stock. We will gladly cooperate with other local nurseries to make combination shipments; however, we have the right to refuse any orders or to place a minimum plant order on combination loads. WE DO OFFER SPECIAL QUOTATIONS ON LARGE QUANTITIES. POLICY FOR DIGGING TREES BETWEEN MAY 15 - SEPTEMBER 30. All orders placed in this time period must be paid for in full prior to digging.
