Prices: This is a wholesale catalog
and priced for the trade only. The freight is not included in the price
of the plants. All prices are F.O.B. Winchester, TN. We require 30% down
to tag & hold nursery stock. Balance is due at time of shipment unless
prior arrangements have been made. Any unpaid balance beyond 30 days of
shipment will be subject to a charge of 1.5% interest.
Shipping: We can arrange trucking
to your area at the current rates of our local Trucking Transportation
Brokers. Please indicate how you want your order shipped. In absence of
specific details we ship the best and most economincal way, but without
assuming responsibility. We guarantee our plants to be true to name and
to be healthy when they leave our Nursery. Once they are delivered to the
carrier, their care is beyond our control and we therefore cannot be responsible
for loss or damage in transit. Make all transit claims with the driver.
Delivery: Customers are responsible
for unloading trucks.
Digging & Shipping Policy: We
can ship from October 15 to April 20. Orders after April 20 will be green
unless dug and in storage. All orders placed either before or after the
dates listed above must be paid in full prior to digging.
Agreements: The parties hereto agree
that any dispute arising out of the sale of these goods shall
be arbitrated exclusively in the Chancery
Court of Franklin County Tennessee, and the State of Tennessee shall be
the forum for any and all litigation that may arise from any sale of goods
by the seller. Either party not prevailing in such action shall be liable
to the prevailing party for reasonable attorney fees. Under no circumstances
are we liable for any amount greater than the original cost of the items,
and all orders are subject to availability. We cannot be held liable for
crop failure. In ordering from us the customer is agreeing to these terms
and conditions.
