Thank you, Kenneth Myers CONDITIONS OF SALE: All orders are accepted subject to crop failures, damage in storage, frost injury or any natural cause beyond our control, and we reserve the right to refund all or any part when such occurs. We are very careful to label varieties true to name and will replace, upon proper proof, any that may prove otherwise or refund original purchase price. We shall in no case be liable for any sum greater than the amount originally received for said nursery stock. Any dispute arising out of the sale of these goods shall be arbitrated exclusively in the Chancery Court for Warren County, Tennessee, and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Either party not prevailing such action shall be liable to the prevailing party for reasonable attorney fees. CLAIMS: Claims of any nature must be made promptly, within 72 hours,
upon receipt of stock. We will not honor claims made after 10
days from receipt of stock. We do not assume responsibility
for stock damaged after acceptance by or in transit by common carrier.
When any damage is apparent make a claim to your delivering carrier.
