PRICES:  This price list is in effect until April 1, 2007 and replaces all previous catalogs. All prices are quoted F.O.B. McMinnville, TN and are based on U.S. dollars.

ORDERS:  Orders are accepted subject to growing conditions, errors in count and with the understanding that the order shall be void should injury befall the crop due to acts of nature or any other cause beyond our control. There will be a minimum of 500 trees.

ERRORS:  We do not take responsibility for any printing errors in this price list.

TERMS:  All accounts are due 30 days from date of invoice. A 1.5% monthly service charge will be charged on all overdue accounts. This represents an 18% annual interest rate. In the event the account plus interest is not paid off in a reasonable (6 months) amount of time and a collection agency or lawyer is required, the purchaser agrees to pay all court and collection fees.

SHIPPING:  All stock will travel at the purchaser's risk and expense F.O.B. McMinnville, TN. Shipments will be made by U.P.S., Motor Freight or Pool Truck. Please let us know when ordering, how and when to ship. Otherwise, trees will be shipped to the best of our judgment without assuming responsibility.

GUARANTEE:  Circle J is careful to select our trees from the best available. Field inspections, excellent cultural practices, and careful grading are given to insure the best quality and the healthiest product. However, if any portion of the stock is proven to be untrue, Circle J retains the option to replace them or refund your purchase price if we are notified in writing of your loss within 10 days after arrival of stock. All replacements or refunds require that your account be paid in full.

CLAIMS:  All claims for damage to stock must be made in writing within 10 days after arrival of stock to Circle J. If the claim is for damage or losses while stock is in transit, please file your claim directly to the carrier or call us when the trees arrive for information on how to handle the situation.

DISCOUNTS:  We offer two types of discounts: (1) Cash and (2) Volume order. These discounts will be determined by type of payment plan chosen or by the volume of trees ordered.
