CONDITIONS OF SALE

We are careful to keep varieties true to name. We give no warranty, expressed or implied, as to the growth or productivity. All orders are excepted without liability for non-performance if labor shortages or delay in transportation should prevent us from making delivery. It is mutually agreed that our liability for any errors or other causes is confined to free replacement and that we reserve the right to refund all or any part of payment.
We accept all orders subject to prior sales of stock and crop conditions. Orders shall be void should injury befall from frost, fire, hail, or other causes beyond our control to prevent us from making delivery.

WARRANTY

We are not responsible under any conditions for the livability or merchantability of plants we ship. This warranty, which is given expressly and in lieu of all other warranties expressed or implied, of merchantability and fitness for a particular purpose, constitutes the only warranty made by the seller. THIS IS IMPORTANT! Buyers agree that any dispute arising out of the sale of these goods shall be litigated in the Chancery Court of Warren Co., Tennessee, and that the State of Tennessee shall be the only forum for any and all litigation which may arise from any sale of goods by the seller. Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.

CLAIMS

Claims for shortages, errors, or any cause, must be made promptly upon arrival of stock We will not honor claims after goods have been accepted, or when written report is not made within five days after arrival of shipment.

PRICES

Prices in this list are based upon present market conditions and are subject to change without notice. All prices are wholesale and F.O.B. McMinnville, Tennessee.

TERMS OF SALE

All orders net 30 days from date of the shipment to established accounts. A cash down payment with order and balance of payment 15 days before shipping on all other accounts. A 5% discount is offered on prepaid orders. We also offer 2%-10 days for established customers. Minimum order $150.

DELIVERY

We strongly recommend our customers to send their own trucks, or hire local trucks, to pick up their orders. Be sure to supply a covering to protect the plants so they will not be damaged in transit. If unable to pick up your order, we have access to local trailers for delivery. All rates are figured at present trucking costs and are subject to change due to conditions beyond our control. All transportation charges to be paid upon delivery.

INSPECTION
Our nursery stock has been inspected by our State Department of Agriculture.
